The Department of Health and Human Services, Office for Civil Rights enforces Section 504 of the 1973 Rehabilitation Act and Title II of the Americans with Disabilities Act. OCR works through complaint investigations and compliance reviews, as well as outreach, technical assistance, and public education to promote voluntary compliance. In the Olmstead decision of June 1999, the Supreme Court held that the ADA’s “integration regulation” requires state and local government to administer services, programs, and activities in the most integrated setting (...) appropriate to the needs of qualified individuals with disabilities. The decision changed the focus from whether a right to more integrated services exists, to under what circumstances and how services will be provided. The New Freedom Initiative announced by President Bush in February 2001 is a broadbased initiative to remove barriers to community living for people with disabilities and promote swift implementation of the Olmstead decision. While psychopathy research has been growing for decades, a relatively new area of research is corporate psychopathy. Corporate psychopaths are simply psychopaths working in organizational settings. They may be attracted to the financial, power, and status gains available in senior positions and can cause considerable damage within these roles from a manipulative interpersonal style to large-scale fraud. Based upon prior studies, we analyze psychopathy research pertaining to 23 moral emotions classified according to functional quality and target. Based upon our review, (...) we suggest that psychopaths are high in moral emotions associated with other-directed negative signals, low in self-directed negative signals, and low in other-directed positive signals. We found no empirical articles related to self-directed positive signals. This understanding of the specific moral emotion deficits of corporate psychopaths provides greater theoretical understanding and practical implications of knowing which individuals not to promote, though more research is needed on moral emotions that are faked for manipulative reasons. Suspicion of “physics envy” surrounds the standard statistical toolbox used in the empirical sciences, from biology to psychology. Mainstream methods in these fields, various lines of criticism point out, often fall short of the basic requirements of measurement. Quantitative scales are applied to variables that can hardly be treated as measurable magnitudes, like preferences or happiness; hypotheses are tested by comparing data with conventional significance thresholds that hardly mention effect sizes. This article discusses what I call “shmeasurement.” To “shmeasure” is (...) to fail to apply quantitative tools to quantitative questions. We “shmeasure” when we try to measure what cannot be measured, or, conversely, when we ask binary questions of continuous measurements. Following the critics of standard statistical tools, it is argued that our statistical toolbox is indeed less concerned with the measurement of magnitudes than we take it to be. This article adds, however, that measurement is not all there is to scientific activity. Most techniques of proof do not resemble measurement as much as voting—a practice that makes frequent use of numbers, figures, or measurements, yet is not chiefly concerned with assessing quantities. Measurement is only one among three functions of the scientific toolbox, the other two being collating observations and deciding which hypotheses to relinquish. I thus make a plea for “shmeasurement”: the mismeasure of things starts to make more sense once we take into account the nonquantitative side of scientific practice. (shrink)

Biological sciences have strived to adopt the conceptual framework of physics and have become increasingly quantitatively oriented, aiming to refute the assertion that biology appears unquantifiable, unpredictable, and messy. But despite all effort, biology is characterized by a paucity of quantitative statements with universal applications. Nonetheless, many biological disciplines—most notably molecular biology—have experienced an ascendancy over the last 50 years. The underlying core concepts and ideas permeate and inform many neighboring disciplines. This surprising success is probably not so much attributable (...) to mathematical and statistical approaches in molecular biology, but rather to the preponderance of qualitative approaches, especially visualization. Visualizations can be afforded by quantitative research, but usually they rely on both, quantitative and qualitative research. I claim the following three features to be responsible for the unceasing zeal for using visualizations: visual representations facilitate reasoning, images can be cognitively processed in a “fast” manner, and abstractions of visual representations prompt conceptual advances. In summary, visualizations have largely contributed to the success of molecular biology by conveying its concepts to other disciplines, and at the same time, eclipsing mere quantitative approaches. However, visualizations also bear the risk of misinterpretation when traversing neighboring disciplines and even more so when pervading nonscientific domains. (shrink)

Filling new spaces, always changing places, ever escaping the Cartesian; the indubitable pinpointing of position. It is never pinned down. Love together what we will be apart. Once together, we will drift apart. Il le faut . Attention is held; it traces the path. It follows each point which traces the arc, the line, the swerve. It is not concerned with the figure being drawn, but rather the movement between one point and the next. The smallest movement. The clinamen of De Rerum Natura is the smallest of swerves, it is nothing more than the minimum — nec plus quam minimum . Michel Serres says of the clinamen , that it is an absurdity — a logical, geometrical, mechanical, physical absurdity. 'The clinamen, from here (its state of absurdity), finds refuge in subjectivity; it passes from the world to the soul, from the physical to the metaphysical, from the theory of inert bodies in freefall to the theory of the free movements of the living.' 2 So this swerve is something of the mind and something of the body, both in action, rather than a body which is merely acted upon. Swerve, however, has a connotation of suddenness. It is a movement which is made to avoid an otherwise inevitable impact. Drift, on the other hand, is the unleashing of something which is then allowed to follow a more complex series of forces. These forces now come from within as well as without. It is no longer tethered; now following tides, winds, flows or pitched slopes, now acting on its own. We are not atoms in freefall. Our attention long ago pulled us from this precipitous descent. We now live, ourselves, as one of the many forces. In the drift, as with the gaze, there is an ease. ‘Ease is the proper name of this unrepresentable space.’ It is the space nearest, the next, the neighboring space. To occupy this space requires a turn, a shift or a drift. It cannot be reached by proceeding straight ahead. ‘..the space adjacent, the empty place where each can move freely, in a semantic constellation where spatial proximity borders on opportune time (ad-agio, moving at ease) and convenience borders on the correct relation.’ 3 Intention always seeks to straighten this line, to make it less complex, to isolate the point of departure and the desired destination. It believes there can be two points and, between them, there must be a straight line. Can there be? Maybe. Must there be? Never. Straight lines may exist, but they can never be followed to the finish. After leaving this point, we will never reach that one without being buffeted at least a little — at least the least. One foot in front of the other, this is a very restrictive dance, less even than a two-step. Straight lines lead only to lost intentions, being the shortest and quickest way to get there. When attention drifts it slowly turns away from the intended target, leaving it for something which pulls the attention away. Now we are for a moment free; all at once we can pivot, now we can waltz. Drifting along the page, deriving from what is seen. Reading is seeing; the movement of the eyes as they drift. Reading in the eyes what has been seen, what has been derived from the act of reading. Reading eyes drift back and forth down the page, now and then jump back and forth, up to the top, one word, back down, quickly a few pages back, now gaze out towards the horizon. When attention drifts it is the gaze that follows. Our attention is not restricted to the path the words follow, but links them together; deriving what is to be seen, rather than read. Any discipline of human knowledge is characterized by three fundamental elements: the complexity of its content, the method used for its elaboration, and the language used for its expression. This article argues that any method for making knowledge is a particular combination of three main components that we can call science, art, and revelation. The right combination depends on the complexity of the slice of reality that we wish to understand in each case. Is there a relationship between the quantity (...) and quality of a particular piece of knowledge and the quantity and quality of its eventual audience? Such a relationship serves, I believe, to avoid certain old misunderstandings. (shrink)

Responsible research and innovation has come to represent a change in the relationship between science, technology and society. With origins in the democratisation of science, and the inclusion of ethical and societal aspects in research and development activities, RRI offers a means of integrating society and the research and innovation communities. In this article, we frame RRI activities through the lens of layers of science and technology governance as a means of characterising the context in which the RRI activity is (...) positioned and the goal of those actors promoting the RRI activities in shaping overall governance patterns. RRI began to emerge during a time of considerable deliberation about the societal and governance challenges around nanotechnology, in which stakeholders were looking for new ways of integrating notions of responsibility in nanotechnology research and development. For this reason, this article focuses on nanotechnology as the site for exploring the evolution and growth of RRI. (shrink)

What is the future of Philosophy of education? Or as many of scholars and thinkers in this final ‘future-focused’ collective piece from the philosophy of education in a new key Series put it, what are the futures—plural and multiple—of the intersections of ‘philosophy’ and ‘education?’ What is ‘Philosophy’; and what is ‘Education’, and what role may ‘enquiry’ play? Is the future of education and philosophy embracing—or at least taking seriously—and thinking with Indigenous ethicoontoepistemologies? And, perhaps most importantly, what is that (...) ‘Future’? These debates have been located in the work of diverse scholars: from the West, from Global South, from indigenous thinkers. In this collective piece, we purposefully juxtapose diverse takes on the future of these intersections. We have given up the urge to organise, place together, separate with subheadings or connect the paragraphs that follow. Instead, we let these philosophers of education and thinkers who use philosophical texts and ideas to sit together in one long read as potentially ‘strange and unusual bedfellows’. This text urges us to understand how these scholars and thinkers perceive our educational philosophical futures, and how the work and thinking they have done on thinking about what the future of that new key in philosophy of education may look like is embedded in a much deeper and richer literature, and personal experience. Without doubt, good numbers that characterize sharply and completely the phenomena being studied, and precise explanation of these phenomena that can be expressed mathematically, are tremendous advantages for a field of science. But not all fields of science are lucky enough to be able to achieve these features. And when they are not, nonetheless to force the phenomena studied to be characterized largely with numbers and the causal mechanisms to be described mathematically can court seriously limiting and distorting the field (...) of study. Research by economists on long-run economic development is an example of a field of research where this has happened. But unfortunately the phenomena are widespread throughout science. (shrink)

Do sensory measurements deserve the label of “measurement”? We argue that they do. They fit with an epistemological view of measurement held in current philosophy of science, and they face the same kinds of epistemological challenges as physical measurements do: the problem of coordination and the problem of standardization. These problems are addressed through the process of “epistemic iteration,” for all measurements. We also argue for distinguishing the problem of standardization from the problem of coordination. Bentham was an influential thinker with an ‘essentially practical mind’. His influence on British social and political reform, however, was indirect, coming largely after his death and largely through the work of his disciples. Bentham's own attempts to put his ideas directly into practice generally had little effect. He came closest to success in the area of penal policy, winning a contract from Pitt's government in the early 1790s to build and manage a penitentiary that was to be organized on (...) the panopticon principle. Bentham saw the penitentiary as the spearhead of prison reform and as a means of effecting a change from transportation to imprisonment as a punishment for serious crime. While Bentham's use of the panopticon principle itself has attracted most attention in the literature, there was more to his scheme than this. The penitentiary proposals were worked out in great detail, they were a conscious application of his theory of punishment, and they were consistent with and an element of his all-embracing plan of social, political, and constitutional reform. This article seeks to clarify the relation between arguments for atheism and descriptions of the summum bonum in Indian Buddhism, through the analysis of one influential text. I begin by noting that a number of writers have detected a tension between, on the one hand, Buddhist refutations of the existence of “God” (īśvara, ātman, puruşa) and, on the other, Buddhist (especially Mahāyāna) claims about the nature of the ultimate (nirvāna, buddha, dharmakāya), which often appears to have God-like qualities. I then (...) turn to a locus classicus of Mahāyāna Buddhist philosophy of religion, the Pramānasiddhi (“Establishment of Authority”) chapter of the Pramānāvarttika (“Commentary on Authority”) of Dharmakīrti (7th century CE). After briefly introducing Dharmakīrti and the Pramānasiddhi chapter, I examine first the chapter’s atheological passages, which include a systematic attack on a Hindu (Nyāya) “argument from design” and a number of important claims about the implausibility of any permanent “spiritual” principle. The arguments are complex and varied, but most turn on the crucial Buddhist assumption that a permanent entity is by definition incapable of interaction with the impermanent, hence utterly unsuitable as a cause or effect. I then examine the chapter’s buddha logical passages, which tend to stress that a Buddha is defined above all by his knowledge of what is to be avoided and adopted by those intent on freedom, i.e., his knowledge of the four noble truths. The Buddha thus described is less notable for his transcendental nature than for his wise, compassionate, and skillful engagement with the world and its creatures---hence less obviously Mahāyānist than the Buddha described by those who articulate a “three-body” (trikāya) theory. I note by way of conclusion that, though Dharmakīrti’s buddhalogy did not prove as influential as his atheology, the juxtaposition of the two reveals an overall metaphysical consistency, in which axiomatic assumptions about permanence, impermanence, and deity are in harmony rather than tension. Objective: To determine the views of people with multiple sclerosis (MS) and professionals in relation to confidentiality, consent and access to data within a proposed MS register in the UK. Design: Qualitative study using focus groups (10) and interviews (13). Setting: England and Northern Ireland. Participants: 68 people with MS, neurologists, MS nurses, health services management professionals, researchers, representatives from pharmaceutical companies and social care professionals. Results: People with MS expressed open and altruistic views towards the use of their personal (...) information to facilitate service provision and research, placing trust in responsible guardianship and legitimate use of their information. Participant’s proposed that people with MS should be able to select their individual level of involvement in a register using levels of consent. It was agreed that access to the register should be governed by a guardianship committee composed of a range of stakeholders. People with MS did not wish their details to be used by marketing agencies and did not consider this a legitimate use of their data. Whilst participants were positive of the role a register could play in promoting research, participants felt that access to data by pharmaceutical industries should be administered by the guardianship committee. People with MS are concerned should their employers be able to access their personal information. Professionals were more cautious than people with MS in their approach to the use of patient personal data within a register. Conclusions: Whilst all stakeholders were positive of the benefits of an MS register, development of such a resource must incorporate robust data security and guardianship measures in order to ensure that, whilst opportunities are maximised, risks to the privacy of individuals and legal challenges to professionals are avoided. We examine and test alternative models for explaining the relationships between resource stress, beliefs that gods and spirits influence weather, and customary beyond-household sharing behavior. Our model, the resource stress model, suggests that resource stress affects both sharing as well as conceptions of gods’ involvement with weather, but these supernatural beliefs play no role in explaining sharing. An alternative model, the moralizing high god model, suggests that the relationship between resource stress and sharing is at least partially mediated by religious (...) beliefs in moralizing high gods. We compared the models using a worldwide sample of 96 cultures from the Standard Cross-Cultural Sample, newly coded data on supernatural involvement with weather, and previously coded data on food and labor sharing. We conducted three types of analysis: multilevel and society-level regressions, and mediational path modeling using Monte Carlo simulations. Resource stress shows a robust effect on beliefs that high gods are associated with weather, that superior gods help the food supply through weather, and that minor spirits hurt the food supply through weather. Resource stress also predicts greater belief in moralizing high gods. However, no form of high god belief that we test significantly predicts more sharing. Mediational models suggest the religious beliefs do not significantly explain why resource stress is associated with food and labor sharing. Our findings generally accord with the view that resource stress changes religious belief and has a direct effect on sharing behavior, unmediated by high god beliefs. (shrink)
